Anti PAP flier

The Temasek Review has published the so-called anti-PAP flier which was distributed to letter boxes in various PAP-held wards.
The incident has been reported to the police and investigations are said to be in process.
We publish the flier here. The black-out parts are by Temasek Review, as published on their website.

    btw, i find that whatever’s written is true.

    it’s funny why police are entertaining this case. ah, i know, because it is a letter against the PAP.

    they seem to have forgotten that Singapore is called the “REPUBLIC of Singapore”, not “PAP’s Singapore”

    Actually this is nothing new.  The facts are already written on everyone face that something is just not right with the current system.  We badly need alternative parties to make things right for our nation and protect every citizens in this country.  Corruption is not acceptable, we want change!

    TR actually posted the uncensored version at first and even claim that they will raise funds for lawyers if the guy was ever caught. Looks like they change their tune very quickly over there

    TR may have kena sent letter of demand.

    Just an opinion on the 5 limbs of the relevant section of the statute.
    (a) to bring into hatred or contempt or to excite disaffection against the Government;
    (b) to excite the citizens of Singapore or the residents in Singapore to attempt to procure in Singapore, the alteration, otherwise than by lawful means, of any matter as by law established;
    (c) to bring into hatred or contempt or to excite disaffection against the administration of justice in Singapore;
    (d) to raise discontent or disaffection amongst the citizens of Singapore or the residents in Singapore;
    (e) to promote feelings of ill-will and hostility between different races or classes of the population of Singapore.

    (e) is not relevant here, as this is not a racist pamphlet. Neither is (c), as the allegations would not be reasonably construed to be against the administration of justice.

    It is not clear if the pamphlet is advocating the alteration of any specific law or the use of any unlawful means (a defence could be made out that the exhortation to “go against the PAP” meant going against them through lawful means, such as voting out PAP MPs in the next election.

    The prosecution is therefore likely to rely on sections (a) and (d).

    Under limb (a), it is possible that a defence could be made that the poster did not excite disaffection against the Government as an abstract entity, but that he/she was exciting disaffection against one political party which happens to be in power.

    Under limb (d), it could be said that the purpose was not to raise discontent among the citizens.

    However, these defences are IMHO unlikely to be accepted by the court. s3(2) is likely to be raised as a defence instead, and I list the relevant section here:

    (2) Notwithstanding subsection (1), any act, speech, words, publication or other thing shall not be deemed to be seditious by reason only that it has a tendency —
    (a) to show that the Government has been misled or mistaken in any of its measures;
    (b) to point out errors or defects in the Government or the Constitution as by law established or in legislation or in the administration of justice with a view to the remedying of such errors or defects;
    (c) to persuade the citizens of Singapore or the residents in Singapore to attempt to procure by lawful means the alteration of any matter in Singapore; or
    (d) to point out, with a view to their removal, any matters producing or having a tendency to produce feelings of ill-will and enmity between different races or classes of the population of Singapore,

    I hope the person does not plead guilty if he/she is arrested and will give the court the opportunity to decide the matter.

    That Today should consider this seditious is reflective of the independence or lack thereof of our local press.

    What I do not understand is why Minister Mentor Lee has not been considered to have excited disaffection amongst the citizenry with his disparaging inflammatory comments about Singaporeans. Someone should take out a private summons against him for his remarks.

    Nothing in this post is meant to be any kind of legal advice to any party (and would not be reasonably construed as such, for goodness’ sakes: it’s a half-baked opinion).

    Wish that more and more people come with this kinda of fliers to make the PAP under pressure, confuse and chaos if possible.
    The pariah mainstream media like CNA(Mediacorp) daily show the red shirt uprising in Bangkok.But doesn’t show an uprising in silence of purely non PR and non new citizen Singaporean on the bread and butter issue.
    Fellow Singaporean’s,let now show solidarity to start bashing the PAP in all ways.

  13. Singaporeans need to understand this – the sooner the better lah. The days of consultation,nation-building,open discussions, transparency are long gone and today the reality is this – lip service, rhetorics and shifting blame on citizens. For now, the ends (to stay in power(votes) and $$$(GDP growth)) is all that matters to the incumbent govt. The means (one eg, allowing unchecked immigration)whether it is impacting Singaporeans livelihoods,sense of belonging or ….add on, is the least they care or think that is worthy of their time and attention. It is no longer govt for the people but govt for self-serving people,cohorts n vested interests only. Singaporeans were pawns and today the foreigners are also pawns. To gamble away … just for political power and $$$ is the worst form of prostitution.
    Lest, I am accused of fear-mongering, look around and scrutinize and one can see thru this bluff and see what it is all about.
    Wake up lah. To pretend and think that we are in good hands is delusional. We were lulled into and Illusion, today the disillusionment is for all to expereince and it is coming first hand and a tidal wave at that.
    Hope intelligence and sense prevails at the polls and bash, yes, but bashing with empty gestures amounts to zilch! Make the votes matter

    You also sensitive like mentioned by TCH.As all Singaporean’s,undisputed and unquestionable I love peace.Bashing doesn’t mean only with phsyical action.
    All this while the enchanted PAP also don’t bashing pure Singaporean’s in that manner but to stop and prevent further bashing till we might become comatose,physcological measure must be taken by us.

    If the PAP feels that the points raised in that letter are not valid, then it is up to them to disprove them.
    Seriously, I do not understand why the big deal over a letter than carries the opinion of one.

    i dun see wats wrong with the uncensored letter, maybe only the *family* involved does.

    to my understanding, it is true that the members of the sensitive elite strawberries did do all those things… or am i mistaken?

    There are some element of truth in the letter
    Besides the  letter takes issue with a political party, not Singapore.
    Since when did Singapore = PAP?
    When the SDP was facing relentless attack from the
    local MSMs, why didn’t the Police charge the latter?

  22. i think some time back, the govt made a distinction between policy disagreements and personal attacks.

    Cost of living and foreign worker issues are not new issues that are out of public domain. Mr Leong even published a book on these issues and it’s selling in bookstores. i think it’s the throwing of angry labels on the govt and spamming people after that crosses their OB marker. (right or wrong, up to individual to decide)

    Anyway, about the legality of of sedition act- i’m not a lawyer so i don’t really know. But if we look at the history, the sedition act came about because of the perceived marxist threats in the 1950s, 1960s, where marxists usually use fliers like this with heavy language to incite discontent. Since the sedition act is created by the british to counter this, using similar tactics probably puts it under the sedition act. (it is afterall, designed to counter this).

    mr chen the belated father of 2 storyline is true..his wife is really really sick and his 2 youn children is growin up..he was employed as a socalled private carpark attendant with a disabilty problem..when the private car park changed managment..they had to fire him simply because he cannot worked a full 44 hours weekly duties..so next step he approached the various cdc/mcys/your a s s/mine a s s thinggie

    this man must be damn frustrated to write this flyer, what he said are nothing fabricated, it is the truth but put in a very negative and blunt way.
    if the police catches him, then this thing will go public,  it will trigger a lot of emotions, especially with people who are suffering and suppressed.
    i think they wont do much, if not, Stimes would have already published the content.
    i also hope in future, the people who write flyer would be less emotional but more factual to illustrate what has gone wrong.

    For those who are unaware, in 2006, Derek Wee wrote a blog post which expressed similar sentiments. It resulted in an MP daughter’s diatribe against him – with the famous line aimed at Derek Wee: “Get out of my elite uncaring face.”

    Whoever this person is, he is the most courageous person in Singapore now. He cares for Singaporeans and dare to take trouble to take his stand to all Singaporeans. He should be nominated as NMP for the next Parliament.
  31. Just imagine everyone staying in those tall HDB flats and throw down those fliers. It is like helicopter scattered everywhere and drop “bombs”.  PAP will be doom big time.

    Seems like someone is paranoid. Can someone confirm that it was the RWB open letter that was sent to DSO for NBC threat assessment? Now this…. Maybe someone should sent a THANK YOU card to see if it will also be tear apart to find for any hidden agenda beneath.
    Frankly, I’ve seen much worse anti-party material on blogs, including the official REACH + of course the T’s sites. The 3 points in the flier are like pin-pricks. There are much bigger issues due to failed policies that are dragging Singaporeans down.
  37. I personally do not see any imflamatory or seditious statement been made in the flier. It may not be politely worded but it’s a true statement. I humbly suggest the flier be made available to everyone TO READ AND (for them)
    MAKE THEIR OWN JUDGEMENT ABOUT THE FLIER  CONTENT. …..worry not; people will know THE TRUTH.

  40. I’m really curious. I’m sure the person who distributed the flyers is reading TOC and TR, good on you. The leaders, make puke everyday with their million dollar salaries. What have they done for us, life   has become  really tough. I was earning a low salary for many years and really it’s  hard to get a job if you’re over 40, 50s’. In the news today they tried very hard to convince us again, all the SPURS and what not program. You could Gan’s uncomfortable body language!!!

    The comments in the letters recently in TR are telling us clearly the extreme frustration of the people.
